By downloading, installing, or using the MyHealthBuddy.AI mobile application or any associated services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Service.
These Terms constitute a legally binding agreement between you and MyHealthBuddy Technologies Pvt. Ltd. ("Company", "we", "us"). If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

The Service is available in India and select international markets. Use of the Service from jurisdictions where it is not authorised is at your own risk and may violate local laws.

Always seek the advice of a qualified physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something you have read or seen in the Service.
In an emergency, call your local emergency services (112 in India, 911 in the US) immediately. Do not rely on the Service in a medical emergency.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
Violation of this section may result in immediate termination of your account and, where appropriate, referral to law enforcement.
Basic features including limited vitals scans, symptom checks, and AI insights are available at no charge.
Advanced features (unlimited scans, full AI insights history, priority doctor access, and extended data retention) are available under a paid subscription billed monthly or annually via the App Store or Google Play.
Refunds are governed by Apple App Store and Google Play refund policies. We will process refunds for billing errors within 14 days of a valid request to billing@myhealthbuddy.ai.
All content, software, trademarks, logos, and technology within the Service are the exclusive property of MyHealthBuddy Technologies Pvt. Ltd. or our licensors, protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service.
You retain ownership of the health data and content you provide. By using the Service, you grant us a limited, non-exclusive, royalty-free licence to process your data solely to provide and improve the Service, as described in our Privacy Policy.
De-identified, aggregated data derived from user interactions (where no individual can be identified) may be used to improve our AI models and publish health trend research.
The Service integrates with third-party providers including Anthropic (AI), Twilio (telemedicine), Zocdoc (booking), shen.ai (rPPG), and Apple HealthKit / Google Health Connect. Use of these integrations is also subject to the third parties' own terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.
Doctors and healthcare professionals accessible through the Service are independent practitioners. We do not employ them, control their clinical decisions, or guarantee the quality of their advice.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
TO THE FULLEST EXTENT PERMITTED BY LAW, MYHEALTHBUDDY TECHNOLOGIES PVT. LTD. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF HEALTH OUTCOMES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.
You agree to indemnify and hold harmless MyHealthBuddy Technologies Pvt. Ltd., its directors, employees, and agents from and against any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of: (a) your use of the Service in violation of these Terms; (b) your provision of false or misleading health information; or (c) your infringement of any third-party rights.
You may delete your account at any time via Settings → Account → Delete Account. Upon deletion, your personal data will be purged within 30 days, subject to legally mandated retention requirements.
We reserve the right to suspend or terminate your access to the Service, without notice or liability, for any reason including:

These Terms are governed by the laws of India. For users in India, disputes shall be subject to the exclusive jurisdiction of the courts of [City], India.

For users outside India, any unresolved disputes shall be referred to binding arbitration under the UNCITRAL Arbitration Rules, with proceedings conducted in English.
We may revise these Terms from time to time. When we make material changes, we will notify you via in-app notification and email at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance. If you do not agree to revised Terms, you must stop using the Service and delete your account.
