Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the MyHealthBuddy.AI mobile application or any associated services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement between you and MyHealthBuddy Technologies Pvt. Ltd. ("Company", "we", "us"). If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Description of Service

MyHealthBuddy.AI is a digital health platform offering:

• Vitals Monitor: Camera-based rPPG technology to estimate heart rate, HRV, SpO₂, respiratory rate, and stress index.
• AI Symptom Checker: AI-powered differential symptom analysis using the Claude AI model.
• Vision AI: Image-based analysis of wounds, skin conditions, medications, prescriptions, and lab reports.
• Doctor Connect: Facilitation of telemedicine consultations with independent, licensed healthcare professionals.
• Find Care: Location-based search for nearby healthcare facilities.
• Insurance Q&A: AI-assisted interpretation of health insurance policy documents.
• AI Health Insights: Personalised health recommendations derived from your vitals and symptom history.

The Service is provided "as a tool" and does not constitute the practice of medicine, nursing, or any other licensed healthcare profession.

3. Eligibility

You must be at least 13 years of age to use the Service. Users between 13 and 17 must have verified parental or guardian consent before registering. By creating an account, you represent that you meet this age requirement.

The Service is available in India and select international markets. Use of the Service from jurisdictions where it is not authorised is at your own risk and may violate local laws.

4. Account Registration

You must create an account to use most features of the Service. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your account credentials and biometric authentication settings.
• Notify us immediately at support@myhealthbuddy.ai if you suspect unauthorised access to your account.
• Not share your account with any other person or use another person's account.

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.

5. Medical Disclaimer

The Service provides health information and tools for informational and educational purposes only. It is not intended to be, and must not be used as, a substitute for professional medical advice, diagnosis, or treatment.

• AI-generated insights, symptom analyses, and vitals readings are not clinically validated diagnostic tools. They may be inaccurate or incomplete.
• Camera-based rPPG vitals are estimates and may differ from readings obtained with certified medical devices.
• Vision AI analyses of medical images are supplementary observations and do not constitute medical diagnoses.
• Insurance Q&A interpretations are for general guidance only and are not legal or financial advice.

Always seek the advice of a qualified physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something you have read or seen in the Service.

In an emergency, call your local emergency services (112 in India, 911 in the US) immediately. Do not rely on the Service in a medical emergency.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Provide false health information that could mislead AI analysis or healthcare providers.
• Impersonate any person, healthcare provider, or organisation.
• Upload images, documents, or content that you do not have the right to share.
• Attempt to reverse-engineer, scrape, or otherwise extract data from the Service.
• Use the Service to harass, threaten, or harm any doctor, healthcare provider, or other user.
• Circumvent or interfere with any security features or access controls.
• Use automated means (bots, scripts) to access the Service without our written permission.
• Use the Service for any commercial purpose without our prior written consent.

Violation of this section may result in immediate termination of your account and, where appropriate, referral to law enforcement.

7. Subscriptions and Payments

7.1 Free Tier

Basic features including limited vitals scans, symptom checks, and AI insights are available at no charge.

7.2 Premium Subscription

Advanced features (unlimited scans, full AI insights history, priority doctor access, and extended data retention) are available under a paid subscription billed monthly or annually via the App Store or Google Play.

7.3 Billing

• Subscriptions auto-renew at the end of each billing period unless cancelled at least 24 hours before renewal.
• Prices are displayed in the App and may vary by region and applicable taxes.
• All payments are processed by Apple or Google; we do not store your payment card details.

7.4 Refunds

Refunds are governed by Apple App Store and Google Play refund policies. We will process refunds for billing errors within 14 days of a valid request to billing@myhealthbuddy.ai.

8. Intellectual Property

All content, software, trademarks, logos, and technology within the Service are the exclusive property of MyHealthBuddy Technologies Pvt. Ltd. or our licensors, protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service.

You retain ownership of the health data and content you provide. By using the Service, you grant us a limited, non-exclusive, royalty-free licence to process your data solely to provide and improve the Service, as described in our Privacy Policy.

De-identified, aggregated data derived from user interactions (where no individual can be identified) may be used to improve our AI models and publish health trend research.

9. Third-Party Services

The Service integrates with third-party providers including Anthropic (AI), Twilio (telemedicine), Zocdoc (booking), shen.ai (rPPG), and Apple HealthKit / Google Health Connect. Use of these integrations is also subject to the third parties' own terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

Doctors and healthcare professionals accessible through the Service are independent practitioners. We do not employ them, control their clinical decisions, or guarantee the quality of their advice.

10. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
• AI-GENERATED HEALTH INSIGHTS ARE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR SPECIFIC HEALTH CONDITION.
• VITALS READINGS ARE EQUIVALENT TO THOSE FROM CLINICALLY VALIDATED MEDICAL DEVICES.

TO THE FULLEST EXTENT PERMITTED BY LAW, MYHEALTHBUDDY TECHNOLOGIES PVT. LTD. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF HEALTH OUTCOMES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless MyHealthBuddy Technologies Pvt. Ltd., its directors, employees, and agents from and against any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of: (a) your use of the Service in violation of these Terms; (b) your provision of false or misleading health information; or (c) your infringement of any third-party rights.

12. Termination

You may delete your account at any time via Settings → Account → Delete Account. Upon deletion, your personal data will be purged within 30 days, subject to legally mandated retention requirements.

We reserve the right to suspend or terminate your access to the Service, without notice or liability, for any reason including:

• Breach of these Terms or our Privacy Policy.
• Fraudulent, abusive, or illegal activity.
• Extended inactivity (accounts inactive for more than 3 years).

Sections 5, 8, 10, 11, and 13 survive termination.

13. Governing Law and Disputes

These Terms are governed by the laws of India. For users in India, disputes shall be subject to the exclusive jurisdiction of the courts of [City], India.

Before initiating any formal dispute, you agree to first contact us at legal@myhealthbuddy.ai and attempt to resolve the matter informally within 30 days.

For users outside India, any unresolved disputes shall be referred to binding arbitration under the UNCITRAL Arbitration Rules, with proceedings conducted in English.

14. Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will notify you via in-app notification and email at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance. If you do not agree to revised Terms, you must stop using the Service and delete your account.
